Jeżeli środki zgromadzone na rachunku PPK uczestnika były objęte małżeńską wspólnością majątkową, to po śmierci uczestnika jego małżonek otrzyma połowę tych środków. W razie rozwodu, do byłego małżonka uczestnika trafią środki przysługujące mu w wyniku podziału majątku wspólnego.
