Montenegrin Constitutional Court Upholds Citizen's Appeal Against Prosecution Consequences

Montenegro's Constitutional Court has upheld a citizen's appeal, ruling that an individual cannot suffer consequences from a prolonged legal process. Part of the proceedings ended due to absolute statute of limitations, while the individual was acquitted of abuse of office after previous convictions were overturned.

"Dio postupka okončan je zbog nastupanja apsolutne zastarjelosti krivičnog gonjenja, dok je za krivično djelo zloupotrebe službenog položaja, nakon ranijih osuđujućih presuda koje su ukidane, oslobođen optužbe. Tokom postupka V. I. je proveo ukupno 24 mjeseca i devet dana u pritvoru. U pritvoru je bio od 13. decembra 1995. do 18. oktobra 1996. godine, a zatim ponovo od 27. januara 1997. do 31. marta 1998. godine", piše u saopštenju Ustavnog suda
